General Contract and Travel ConditionsThank you for your interest in Amira Dive and Travel Inc. services. The following general contract and travel conditions are based on the general contract and travel conditions for all-inclusive travel services as stipulated by the Swiss Travel Association (Issue 1994). Effective fromApril 21st 2025 1. What do these General Contract and Travel Conditions cover? 1.1. These General Contract and Travel Conditions govern the legal relationship between you and Amira Dive and Travel Ltd. (ADT Ltd) for all travel arrangements offered and/or organized by ADT Ltd. 1.2. These conditions do not apply to the following: - "Flight-only services" (e.g., APEX/PEX airline tickets) arranged by ADT Ltd. - Individualized services provided by third-party agencies. For such services, the general contract and transport conditions of the respective airline or service organization apply. If your booking agency arranges travel or services through a thirdparty provider, the conditions of that third party will apply. In such cases, ADT Ltd will not be your contractual partner 2. Registration / Formation of Contract Between You and ADT Ltd 2.1. The contract between you and ADT Ltd becomes effective upon your unreserved acceptance of the booking arranged by your agency. From that moment, all rights and obligations specified in the contract, including these General Contract and Travel Conditions, take full effect. 2.2. If an individual already registered with ADT Ltd books reservations on behalf of additional travelers, that individual is responsible for ensuring compliance with all contract terms on behalf of those travelers - particularly regarding payment and pricing. These conditions apply equally to all travelers included in the booking. 3. Services 3.1. The services provided are based on descriptions in our travel brochures and advertisements. Special requests are only valid if confirmed in writing by your booking agency. Unless otherwise specified, ADT Ltd’s services commence from the hotel or airport at the designated point of embarkation. You are responsible for arranging and arriving punctually at these departure points. 3.2. Services included in ADT Ltd packages - Transfers to and from the airport or hotel at the designated port of embarkation, and to/from the vessel MSV AMIRA - Accommodation on board in a single, double, or twin cabin with private shower, toilet, and air conditioning - 2 to 4 guided dives per day (including one dawn or night dive, subject to conditions at the dive site or anchorage). Note: No dives are typically scheduled on arrival or departure days. Missed dives do not qualify for reimbursement - Nitrox fillings (No compensation shall be provided in the event of unavailability) -All-inclusive meal service on board, including beverages (excluding canned and bottled drinks) - Multilingual travel guides on board - All scheduled excursions -Use of ENOS® (Electronic Rescue and Locating System) 3.3. Services Not Included - Fuel surcharges and harbor taxes (as specified in advertisements) - All canned, bottled, or packaged beverages - Alcoholic beverages including beer, wine, and spirits - Diving lessons - Rental of 15L tanks - Rental of diving equipment - Purchase of merchandise and souvenirs on board - Tips for the crew (see recommendations in the Amira information sheet) - Charges for excess luggage (on both international and domestic flights) - Dive and travel insurance (e.g., DAN, Travel Guard, etc.), as well as medical insurance - Other paid services and items available on board the MSV AMIRA - National marine park fees (Komodo National Park, Raja Ampat, Banda Sea, and other regions), and other local fees. These fees are subject to change and must be paid at the time of reservation and before the trip begins 4. Prices and terms of payment 4.1. Prices Prices for travel arrangements are based on the current ADT Ltd price list. Unless otherwise specified in advertisements, prices are listed per person, in Euros (€) or US-Dollars (USD), and are based on double occupancy per cabin. The price applicable is the one valid at the time of booking. For information regarding possible price changes, see Section 6. 4.2. Terms of Payment 4.2.1. For individual, part-charter, or full-charter reservations, a 20% pre-payment of the total booking price is required within 10 days of the booking date. Failure to do so will result in cancellation of the reservation. 4.2.2. For individual bookings, the remaining balance must be paid no later than 90 days before the departure date. 4.2.3. For part- and full-charter bookings: - A second pre-payment of 30% is due 180 days before departure - The remaining balance must be paid no later than 90 days prior to departure 4.2.4. Travel documents will be sent after full payment has been received, unless otherwise stated. 4.2.5. ADT Ltd reserves the right to withhold services in the event of late payment of either the pre-payment or remaining balance. 4.2.6. For short-notice bookings (i.e., made within 90 days of departure), the full booking amount must be paid at the time of reservation. 4.2.7. Please note that your booking agency may charge an administrative fee in addition to the prices listed in the ADT Ltd brochure. Payments made by credit card may incur a service charge. 5. Amendments or Cancellations Requested by You 5.1. Notification If you wish to modify your booking or cancel your trip, you must notify your booking agency personally or by registered mail. Any travel documents already issued must be returned to the booking agency. 5.2. Booking Modifications For changes such as name substitutions, alternate travelers, adjustments to travel dates within the valid period, changes to ancillary services, destination, or departure location, a processing fee will apply: - USD 100 per person, up to a maximum of USD 200 per booking - Cancellation handling fees are generally not covered by cancellation insurance (see Section 5.5) 5.3. Cancellation Fees – Individual Bookings If an individual booking is modified or canceled before departure, the following cancellation fees apply: - More than 90 days before departure: 20% of the total invoice - 90–61 days before departure: 50% of the total invoice - 60–0 days before departure or no-show: 90% of the total invoice Different cancellation terms may apply to bookings with special airfare conditions, which are indicated in the respective advertisements. The date of receipt of your written or oral notification at your booking agency determines the cancellation fee. For notifications received on a Saturday, Sunday, or public holiday, the next working day will be considered the effective date. 5.4. Cancellation Fees – Part and Full Charters For modifications, booking changes or cancellations, the following cancellation charges apply: - more than 180 days before departure: 20% of the total invoice - 180 - 91 days before departure: 50% of the total invoice - 90 - 0 days before departure or no show: 90% of the total invoice Different cancellation terms may apply to bookings with special airfare conditions, which are indicated in the respective advertisements. The date of receipt of your written or oral notification at your booking agency determines the cancellation fee. For notifications received on a Saturday, Sunday, or public holiday, the next working day will be considered the effective date. 5.5. Cancellation Cost Insurance In certain cases, cancellation costs may be covered by your cancellation insurance, if such coverage has been arranged in advance or is part of your booking package. Coverage and reimbursement depend on the terms of your specific insurance policy. If no cancellation insurance is included in your booking, we strongly recommend purchasing one. Please note that in the event of trip cancellation, the insurance premium remains payable. 5.6. Substitute Traveler If you are unable to undertake the trip, you may nominate a substitute traveler. The substitute must be able and willing to enter into the contract under the existing conditions. Should a replacement traveler be accepted, you and the substitute will be jointly liable for payment of the full travel price and any applicable processing fees as outlined in Section 5.2. ADT Ltd will inform you within a reasonable timeframe whether the proposed substitute is eligible to participate. For trips that have specific participation criteria, a review is necessary and may take a few days. If the substitute is proposed too late or is unable to meet travel requirements (e.g., due to legal restrictions or official directives), your cancellation will be treated as a regular cancellation under the applicable provisions in Section 5.2 et seq) 6. Modifications to Brochure Information, Prices, or Transportation Regulations 6.1. Changes Prior to Contract Conclusion ADT Ltd expressly reserves the right to modify brochure content, service descriptions, online pricing, and published rates at any time prior to booking. Your booking agency will inform you of any such modifications before the contract is finalized. 6.2. Price Modifications After Contract Conclusion In rare cases, it may be necessary to increase the travel price after the contract has been concluded. This may occur under the following circumstances: - Increases in transportation costs (e.g., fuel surcharges) - Increases in or new government taxes, levies, or fees (e.g., airport taxes, embarkation/ disembarkation fees, sales taxes) - Exchange Rate Changes from Euro to Indonesian Rupiah: If fluctuations in the exchange rate between the Euro and the Indonesian Rupiah result in increased costs for the travel services, such additional costs may be passed on to you, leading to a corresponding increase in the travel price. This adjustment may be made up to three weeks prior to the start of the trip. Should the price increase exceed 10% of the original travel price, you are entitled to the rights specified in Section 6.4. - Exchange Rate Changes from Euro to USD: ADT Ltd’s base currency is the Euro. When prices are quoted in USD, the Euro amount is converted using the prevailing exchange rate at the time. Your invoice will specify the exchange rate up to which ADT Ltd guarantees the quoted price, even in the event of a USD depreciation (typically 5–10% above the quoted tour price). If this threshold is exceeded, ADT Ltd reserves the right to charge the difference, up to one week before the final payment is due. By paying the deposit, you accept this contractual condition. In this case, the rights outlined in Section 6.4 do not apply. If the full travel price is paid within one month of booking, ADT Ltd guarantees the exchange rate, regardless of subsequent fluctuations. 6.3. Changes to Itinerary or Transport After Booking and Before Departure: ADT Ltd may need to make changes to itineraries or services (e.g., accommodation, airlines, routes, transportation modes) due to unforeseen or unavoidable circumstances. Equivalent alternatives will be offered where possible. You will be informed promptly of such changes and any potential impact on your travel costs. 6.4. Your Rights Following Significant Changes: If changes to your itinerary or services result in major modifications or a price increase of more than 10%, you have the following rights: - Accept the revised terms - Cancel the booking in writing within five (5) days of receiving notice, with a full refund of payments made - If no response is received within five (5) days, ADT Ltd will consider the changes accepted (proof of postmarked notice within this timeframe will suffice) In the event of additional charges due to a devaluation of the USD, the rights outlined in section 6.4 do not apply (see section 6.2: Exchange rate changes from Euro to USD). 7. Trip Cancellation by ADT Ltd 7.1. Cancellation Due to Customer Behavior ADT Ltd reserves the right to cancel your trip if your behavior or failure to meet obligations justifies such action. In this case, any payments made will be refunded. No further claims will be accepted. Cancellation fees, as per Section 5.2 et seq, remain applicable. 7.2. Minimum Group Size Not Met Each trip requires a minimum of six (6) participants. If this number is not met, ADT Ltd may cancel the trip up to three (3) weeks prior to departure. 7.3. Force Majeure or Strikes ADT Ltd may cancel a trip due to Force Majeure (e.g., natural disasters, pandemics) or unavoidable human actions(e.g., war, civil unrest, strikes) that would jeopardize safety or the feasibility of the trip. 7.4. Cancellation for Other Reasons ADT Ltd may also cancel a trip for other significant reasons. In such cases, your rights will follow the provisions outlined in Section 6.4. 7.5. Cancellation Compensation: If a trip is canceled due to insufficient participants (Section 7.2) or other valid reasons (Section 7.4), and a suitable alternative package cannot be offered, ADT Ltd will compensate you as follows: - USD 80 per person, with a maximum of USD 160 per booking 8. Changes to Itinerary or Service Interruptions During the Trip 8.1. Minor Changes ADT Ltd reserves the right to make minor changes to the itinerary or services, provided that the essential characteristics of the trip remain unaffected. 8.2. Major Changes If significant itinerary changes occur that materially affect the nature of the trip, ADT Ltd will provide financial compensation for any services not rendered, based on the proportional cost of the missed service relative to the total package price. 9. You start the trip but are not able to finish it If you are unable to participate in the trip—or parts of it—due to delays in arrival, no refund will be issued. Costs for special transport arrangements or diving gear rentals remain your responsibility. In the event you must cut your trip short, no refund of the travel arrangement price is possible. However, in emergencies (e.g., illness, accident, family emergencies), ADT Ltd’s tour guide, local representative, or service provider will assist you in arranging an early return. All associated costs are your responsibility. We strongly recommend obtaining return travel insurance, which is not included in the travel package. Further information is available upon request from your booking agency. 10. Complaints 10.1. ADT Ltd reserves the right to modify the program or individual services for legally permissible reasons, provided such changes do not significantly alter the overall nature or character of the trip. 10.2. Complaints, Time Limits, and Compensation Claims If your trip does not conform to the agreed terms of your booking contract or you suffer personal loss or damage, you are responsible for submitting a complaint to an ADT Ltd representative, your booking agency, or the local service provider on the day of your return or as soon as reasonably possible. You must also request appropriate compensation at that time 10.3. The booking agency, local ADT Ltd representatives, or service provider will make reasonable efforts to address your complaint in a timely manner. If no remedy is provided within a reasonable period during the trip, you are required to submit your complaint in writing to ADT Ltd, your booking agency, or the service provider. Please note that these parties are not authorized to accept or confirm any claims for compensation on behalf of ADT Ltd 10.4. Self-Help Remedy If no adequate resolution is provided within a reasonable timeframe during the trip and the issue results in significant inconvenience or damage, you may take reasonable measures to resolve the matter yourself. ADT Ltd will reimburse you for costs incurred, provided they are in line with the originally booked travel arrangements (e.g., hotel category, transportation standard) and are supported by receipts. Written confirmation of the issue must be obtained at the time of the incident (see Section 11). 10.5. Submitting Compensation Claims to ADT Ltd To assert your claim for non-performance or non-reimbursement, you must submit a detailed written complaint to ADT Ltd no later than one (1) month after the end of your trip. Supporting evidence must be attached and the complaint should also be submitted to your booking agency, the local ADT Ltd representative, or the service provider. 10.6. Forfeiture of Claims Failure to comply with the reporting requirements outlined in Sections 10.2 and 10.3 will result in forfeiture of your right to any compensation, including self-help reimbursement, price reductions, contract cancellations, or refunds. Similarly, your right to claim compensation will lapse if the complaint is not submitted within one (1) month following the end of your trip. 11. Liability regulations 11.1. Compensation for Non-Performance ADT Ltd shall reimburse you, in accordance with the provisions below, for the value of any services that were agreed upon but either not provided or inadequately provided, for any additional expenses incurred, or for damages suffered—provided that the ADT Ltd tour manager, local ADT Ltd representative, or service provider was unable to offer an equivalent replacement on site, and ADT Ltd is deemed liable. 11.2. Limitations and Exclusions of Liability 11.2.1. International Agreements and National Laws: If international agreements or national laws provide for limitations or exclusions of liability for damages arising from non-performance or improper performance of contractual obligations, ADT Ltd’s liability is limited to the extent permitted under those agreements and laws. Such limitations frequently apply in the transportation sector (e.g., air travel, sea voyages, and rail transport)). 11.2.2. Liability Exclusions: ADT Ltd is not liable for non-performance or partial performance of the travel contract due to the following circumstances: - Your own actions or omissions before or during the trip. - Your failure to follow instructions given by travel guides or ADT Ltd representatives. - Unforeseeable or unavoidable acts or omissions of a third party not involved in delivering the agreed services. - Force Majeure or any event that ADT Ltd, its agents, or service providers could not foresee or prevent despite exercising due diligence. In such cases, any liability claims against ADT Ltd are excluded. 11.2.3. Personal Injury ADT Ltd is liable for personal injury resulting from non-performance or improper performance of the travel contract only within the scope of the applicable contract, travel conditions, international agreements, and national laws. 11.2.4. Property and Financial Damages For any additional damages (e.g., property or financial loss) resulting from nonperformance or partial performance, ADT Ltd’s liability is limited to a maximum of twice the booking price per person—unless such damage is the result of willful misconduct or gross negligence. These limitations apply unless international agreements or national laws impose stricter liability caps or exclusions. ADT Ltd is not responsible for personal items (e.g., diving gear, diving lamps, cameras, etc.) that remain under your care throughout the trip. This includes any assistance provided by the crew in handling such items. 11.2.5. Valuables You are solely responsible for the safekeeping of valuables such as cash, jewelry, credit cards, photo/video cameras, and other electronics. Hotels may provide in-room safes for storage. Do not leave valuables unattended in vehicles or public spaces. ADT Ltd assumes no liability for theft, loss, or misuse of credit cards or checks. 11.2.6. Rental Equipment: The user/borrower is liable for the loss of or damage to rental equipment (e.g., ENOS devices, diving gear, cameras). 11.2.7. Air and Sea Travel Despite careful planning, ADT Ltd cannot guarantee adherence to travel schedules. Delays may occur due to high traffic volumes, road accidents, airport congestion, rerouting, border control delays, or natural events. ADT Ltd is not liable for such delays. We strongly recommend allowing for possible delays when planning your trip. 11.2.8. Optional Events and Excursions Local events or excursions outside the agreed travel program may be offered during the trip. These activities may involve certain risks (e.g., strenuous hikes, heat exposure, physical demands, difficult terrain). Participation is entirely at your own discretion and risk. Some of these excursions may be organized by third-party providers (external services). In such cases, ADT Ltd is not your contractual partner and accepts no liability. If excursions are organized by ADT Ltd, these General Terms and Conditions apply. 11.3. Liability Beyond the Standard Travel Agreement Any non-contractual liability is subject to the provisions of applicable international agreements. The liability limitations and exclusions in these General Terms and Conditions, as well as those in international agreements or national laws, apply only if they provide for further or stricter restrictions. For losses other than personal injury, liability is limited to a maximum of twice the booking price per person, unless otherwise specified by international agreements or national laws. 12. Insurances The liability coverage provided by travel, transport, and airline companies is limited. ADT Ltd strongly recommends that you obtain supplementary insurance coverage, such as baggage insurance, trip cancellation insurance, travel health insurance, diving insurance, and emergency medical evacuation insurance 13. Entry, Visa, and Health Regulations 13.1. Please ensure that your booking office clarifies the applicable passport and entry requirements for you. These may vary depending on your nationality, and ADT Ltd accepts no liability for any damage resulting from non-compliance with these requirements. 13.2. You are solely responsible for obtaining the necessary travel documents and visas. If you are unable to secure the required documentation in time for departure, you will be subject to the cancellation terms outlined in the contract. 13.3. You are responsible for complying with all applicable entry requirements, health regulations, and foreign currency regulations of your destination country. Please verify that you have all necessary documents before departure. 13.4. ADT Ltd advises that if you are denied entry into a country, you will be responsible for covering the cost of your return journey. Furthermore, we urge you to familiarize yourself with import and export regulations concerning restricted goods, as well as the legal consequences of noncompliance. 13.5. All participants in diving cruises are responsible for carrying the required personal documentation, such as a valid diving certification, logbook, and medical certificate. If you are excluded from diving activities due to insufficient qualifications, incomplete records, or medical concerns, ADT Ltd accepts no liability for any resulting claims. 13.6. All divers with pre-existing health conditions must personally assess and confirm their fitness to dive. Any such conditions must be disclosed to the dive operator. If diving is denied due to suspected health risks, ADT Ltd bears no responsibility and compensation claims are invalid. 13.7. Reconfirmation of Air Tickets On unaccompanied trips, you are responsible for reconfirming your flight details, including departure dates and times. Refer to the relevant brochures for guidance. Failure to reconfirm may result in the forfeiture of your transportation arrangements, and any resulting costs will be your responsibility. 14. Governing Law and Jurisdiction 14.1. The legal relationship between you and ADT Ltd is governed by the laws and regulations of Switzerland. 14.2. The invalidity of any individual provision of the contract shall not affect the validity of the remaining provisions. 14.3.
